Subscriber Terms & Conditions
Including the subscriber indemnity agreement
Version 2026-10-25-v10
Effective 25 October 2026. Please read these terms, including the subscriber indemnity, before accepting.
Service provider and contracting party: Awesome! Pte Ltd, UEN 202646687G, trading as MYNCS ("MYNCS", "we", "us"). Contact: [email protected]. These Subscriber Terms & Conditions, including the indemnity in section 10, form the agreement between the operator and the person or organisation accepting them ("you").
Awesome! Pte Ltd is the provider of MYNCS and the contracting party under this agreement.
1. Acceptance and authority
By selecting “I agree to the Terms & Conditions” and completing checkout or activating complimentary access, you agree to this version of these terms. You must be at least 18 and legally able to enter this agreement. If acting for an organisation, you confirm you have authority to bind it. These terms apply to your subscription and authorised use of MYNCS; they do not retrospectively record acceptance for existing users.
2. The service
MYNCS provides digital namecards, contact storage and organisation, namecard scanning, event and follow-up tools, and supported exports or integrations. Features depend on your plan and availability. AI and OCR can misread names, numbers and other information. Review and correct results before saving, sharing, contacting anyone or making decisions. MYNCS does not guarantee the identity, consent, accuracy, solvency or suitability of a contact. It does not provide legal, financial or other professional advice.
3. Accounts and security
Provide accurate registration details, keep login credentials private and promptly report suspected misuse. You are responsible for users you authorise and activity you direct, subject to our own security and legal responsibilities. Do not sell, share or transfer your account without our written agreement. Do not attempt to access another user’s contacts or bypass account permissions or usage limits.
4. Plans, prices and renewal
The plan and total displayed before you confirm checkout govern that purchase. For US-dollar accounts, current standard offers are US$39 annually with 1,000 included scans per paid year, or US$3.50 monthly with 83 included scans per paid month. A scan means an AI namecard scan charged by the service’s usage ledger. Included allowances reset with the applicable paid period and do not accumulate. Optional scan packs and website setup services are separate purchases, subject to their displayed price and approved scope. Taxes or additional charges, if applicable, must be disclosed before payment.
Paid subscriptions renew only as expressly disclosed and authorised at checkout. The renewal acknowledgement is separate from acceptance of these terms. Cancel future renewal through Billing or contact us if that option is unavailable. Cancellation takes effect at the end of the paid period; it does not immediately end the access already paid for. We will give advance notice of price changes affecting renewal and an opportunity to cancel before the new price takes effect. We will not charge merely because you registered or entered a coupon.
5. Coupons and complimentary access
A valid coupon grants only the duration and scans shown when you apply it. Access begins on confirmed activation. Code-specific redemption deadlines, user limits and account eligibility apply. Unless an offer expressly states otherwise, each account may redeem the same code once; codes cannot be exchanged for cash, combined or used to replace an existing paid subscription. Complimentary access ends on its displayed date and does not automatically become a paid subscription. Changes to an offer apply to future redemptions, not an allowance already granted, except where redemption involved fraud or misuse or a mandatory legal requirement applies.
6. Payments, refunds and service interruption
Payments are processed through Stripe, as identified at checkout. Keep billing information accurate. Contact us about duplicate, incorrect or unauthorised charges. Except where the law requires otherwise, cancelling for convenience does not entitle you to a refund for elapsed service or unused scans in the current period. This does not exclude statutory cancellation, refund or other consumer rights. If we permanently discontinue your paid service or terminate it without your material breach, we will refund the unused prepaid subscription period proportionately, subject to any greater legal entitlement. Temporary interruptions, maintenance and third-party outages may occur; we will take reasonable steps to restore the service. No promise of uninterrupted operation is made.
7. Your contacts, content and permitted use
You retain rights in content you upload. You give us a non-exclusive licence to host, process, reproduce, display and transmit that content only as reasonably necessary to provide, support and secure the service and carry out your instructions. You must have a lawful basis and any required permissions to collect, upload, scan, store, share, export and use personal information, logos, photographs and other content. Possession of a namecard does not by itself authorise unrestricted marketing.
Do not upload unlawful, infringing, deceptive or malicious material; harass or spam people; use harvested contact lists unlawfully; evade opt-outs; distribute malware; interfere with the service; reverse engineer contrary to applicable law; or bypass payment, security or scan limits. You must comply with applicable privacy, electronic marketing and do-not-call rules. Do not upload payment-card credentials, passwords, government identification documents or sensitive personal information that is unnecessary for contact management.
8. Personal information and public sharing
We process account details, subscriber contact information, uploaded namecards and images, saved contacts and notes, usage, consent, support and billing records to operate accounts, deliver the features requested, administer access and billing, provide support, detect misuse and meet legal obligations. Requested scanning or integrations may require relevant information to be processed by external hosting, AI/OCR, payment or other service providers. Where transfers cross borders, applicable legal safeguards remain required; these terms do not waive them.
Publishing a digital namecard or sharing a link makes the selected content available to recipients and potentially the public. Check the preview and permissions before publishing. Copies already downloaded or shared by recipients may remain outside our control. Contact [email protected] for access, correction, deletion, privacy questions or complaints. We may retain information reasonably required for legal, security, billing or dispute purposes and manage backup copies through applicable retention processes. This section is not a substitute for any additional privacy notice or processing agreement required by law.
Acceptance of these terms is not consent to optional marketing, and it is not consent on behalf of the people in your contact list. Each party remains responsible for the privacy obligations that apply to its activities. Nothing in these terms transfers our own statutory duties to you.
8.1 Stored contact data is not used for our marketing
Awesome! Pte Ltd does not use subscribers’ uploaded namecards, saved contacts, contact notes, images or other stored contact content for its own marketing, advertising or audience targeting. We do not sell or rent that content for marketing, or permit service providers to use it for their own marketing. We do not send marketing communications to someone merely because their information has been uploaded, scanned or stored in MYNCS. Processing needed to provide requested features, support and security remains subject to this agreement and applicable law.
8.2 Subscriber marketing and service notices
Our own marketing communications are directed only to MYNCS subscribers, using their subscriber account contact details, subject to applicable consent requirements and their marketing preferences. Subscription or acceptance of this agreement does not by itself constitute consent to optional marketing. Where consent is required, we obtain it separately. You may opt out using the unsubscribe method provided in a marketing message or by contacting [email protected]. We will honour withdrawal within the period required by applicable law and will not require marketing consent as a condition of access to MYNCS.
Necessary account, security, billing, contractual and service notices are separate from optional marketing and may continue where permitted by law. This distinction does not allow us to disguise promotional messages as service notices. If you use MYNCS to prepare your own communications, you remain responsible for the lawful basis, recipient permissions and opt-outs applicable to those communications.
8.3 Data protection responsibilities and safeguards
We remain responsible for the personal data protection obligations applicable to our activities under Singapore’s Personal Data Protection Act 2012 and other applicable law. Where we process stored contact data on your behalf and instructions, we act as a data intermediary to the extent that role applies; where we determine our own purposes for account administration, security or billing, we remain responsible for that processing. These descriptions do not override the roles or obligations imposed by law. You must have the authority and lawful basis required for your instructions, and we may refuse instructions that would breach applicable law.
We will make reasonable security arrangements to protect personal data against unauthorised access, collection, use, disclosure, copying, modification, disposal and similar risks. Access and disclosure will be limited to what is reasonably necessary for the stated purposes, your authorised instructions or legal requirements. Where providers process personal data for us, we will use appropriate contractual or other legally recognised safeguards. Overseas transfers must meet applicable requirements for a standard of protection comparable to that required under the PDPA. This is not a guarantee that no security incident can occur.
8.4 Requests, retention and incidents
You, and individuals whose personal data is held in MYNCS, may contact [email protected] with privacy questions, complaints or requests for access, correction, withdrawal of consent or deletion. We may reasonably verify identity and authority before acting. We will handle requests within applicable legal requirements, explain relevant exceptions or necessary consequences of withdrawal, and coordinate with the responsible subscriber where a request concerns data processed on that subscriber’s behalf. Withdrawing optional marketing consent does not end service access. Deletion requests remain subject to lawful retention requirements; this agreement does not promise an unconditional right to immediate erasure.
We will cease retaining personal data, or remove its association with identifiable individuals, when retention no longer serves its original purpose and is no longer necessary for legal or business purposes. Any retained security, billing, consent or dispute records must remain limited to the applicable purpose. Backup copies are subject to controlled retention and expiry and must not be repurposed for marketing.
If a personal data breach occurs, we will assess it and notify the Personal Data Protection Commission, affected individuals and/or the subscriber for whom we process the data where required, within applicable statutory timeframes. We will take reasonable containment and remediation measures and cooperate as required by law. Neither subscriber indemnities nor liability limitations remove duties or remedies that cannot lawfully be excluded.
8.5 Rights of people whose information you upload
Your acceptance of this agreement does not waive, release or restrict the rights of people whose namecards or other personal data you upload, including people who do not hold a MYNCS account. You cannot waive those rights on their behalf merely by subscribing to or using MYNCS. Any authority to provide instructions or consent for another person must be valid under applicable law.
Nothing in this agreement excludes a qualifying person’s right to seek relief for loss or damage directly resulting from a contravention covered by section 48O of Singapore’s Personal Data Protection Act 2012, subject to that section’s conditions and applicable procedures. Contractual indemnities and liability limitations do not override rights or remedies that cannot lawfully be excluded.
These contractual provisions do not replace our obligation to maintain appropriate privacy notices and actual data-handling practices that meet applicable law. We remain responsible for the obligations applicable to our activities, including implementing the safeguards described in this section. Accepting this agreement is not a waiver of those obligations or evidence, by itself, that our practices comply with the law.
9. MYNCS intellectual property and third-party services
We and our licensors retain rights in MYNCS software, branding and service materials, excluding your content. During authorised access, you may use the service for its intended purposes. External platforms have their own terms and permissions. We do not guarantee their continued availability or that a draft, export or hand-off has been delivered unless the service confirms delivery. You are responsible for reviewing content before sending or publishing it.
10. Your responsibility for misuse (subscriber indemnity)
This clause protects Awesome! Pte Ltd, the provider of MYNCS, against certain costs caused by a subscriber’s wrongdoing. In this clause, “you” means the subscriber accepting this agreement.
If someone outside this agreement makes a claim against Awesome! Pte Ltd directly because you seriously breach section 7, unlawfully use another person’s information, supply content that infringes another person’s rights, commit fraud or deliberately engage in wrongful conduct, you agree to compensate Awesome! Pte Ltd for the resulting reasonable, documented losses, damages and external legal costs. This obligation applies only to the extent directly caused by that conduct and only where permitted by law and reasonable in the circumstances.
You are not required under this clause to cover losses caused by our negligence, breach of this agreement, unlawful processing of information, fraud or deliberate wrongful conduct. You are also not responsible for liabilities that the law does not allow us to transfer to you.
We will tell you promptly about a claim, provide reasonable information and cooperation, and take reasonable steps to reduce losses. If a delay in telling you materially harms the defence, your responsibility is reduced to that extent. Arrangements for responding to the claim must reasonably protect both parties’ interests. Neither party may agree to a settlement that admits fault or requires the other party to do something other than pay money without that party’s prior written consent; that consent must not be unreasonably withheld. We cannot recover the same loss twice.
If you are a consumer, this clause applies only where lawful and fair. It does not require you to compensate us for our own negligence or breach where that would be prohibited or unreasonable.
11. Responsibility and liability
We will provide the service with reasonable care and skill. To the extent lawful and reasonable, neither party is responsible for losses that were not reasonably foreseeable when this agreement was entered into, and we are not responsible for business profit, opportunity or anticipated savings lost through use of the service. Subject to the exceptions below, our aggregate contractual liability connected with the service is limited to the greater of 100 Singapore dollars (SGD) or the fees you paid MYNCS for the service in the 12 months before the event giving rise to the claim.
These limitations do not exclude or restrict liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, obligations that cannot lawfully be limited, or mandatory consumer and personal-data rights or remedies. A limitation applies only if permitted by applicable law and, where required, reasonable. The indemnity in section 10 is subject to its own express limits and does not expand our exclusions.
12. Suspension, termination and your records
We may restrict access where reasonably necessary to address serious misuse, a security threat, unlawful conduct or unpaid fees. Where practical and lawful, we will explain the reason and give an opportunity to resolve it. Contact us to dispute a restriction. When paid or complimentary access expires, features requiring active access may stop; available viewing and export functions remain subject to account security and lawful restrictions. Export records you need before closing your account. Termination does not remove accrued lawful payment obligations or rights; provisions that by their nature must survive, including confidentiality, accrued claims and the limited indemnity, survive only as necessary.
13. Changes to terms
We will identify versions and dates and provide reasonable notice of material changes. Where required, we will obtain fresh acceptance before applying them. Revised terms do not retrospectively change an existing claim or a coupon allowance already granted. Continued use alone will not be treated as acceptance where applicable law requires express agreement.
14. Disputes and governing law
Contact [email protected] with a description of the issue so we can first try to resolve it in good faith. Subject to mandatory rights and forums available to you under applicable law, Singapore law governs this agreement and the Singapore courts have non-exclusive jurisdiction. If you are a consumer outside Singapore, this clause does not deprive you of mandatory protections or access to courts available under the law applicable to you.
15. General
If a provision is unenforceable, the rest of the agreement continues to the extent lawful. A failure to enforce a right is not a waiver. These terms, the offer confirmed at checkout and any separately agreed written service scope form the agreement for the relevant service, subject to mandatory law. No verbal statement changes them without written agreement. We may not transfer the agreement in a way that materially reduces your rights without any notice or consent required by law.
16. Acceptance record
We record the accepting account, server timestamp, document version and document fingerprint, together with the activation or checkout context. The agreement is presented before you accept; the checkbox is not selected by default. You can retain a copy using your browser’s print or save function. This record does not certify that a person read or understood every provision and does not waive any mandatory rights.
Card-free introductory access
Eligible new customers receive five days of free access and 10 AI scans from the server-recorded activation time. No card is required and the trial never becomes a paid subscription automatically. After expiry you can view existing cards and contacts, export your data, manage billing and delete your account. Subscribe for US$39/year to resume paid features, with 1,000 included scans per subscription year. Choosing a paid subscription starts billing immediately and it renews until cancelled.
Existing free users may receive a separately announced five-day transition period. Existing purchased scan credits approved for continued use remain usable after that transition; other paid features require subscription. No unused purchased credits are removed. Prior card-authorised subscriptions and trials retain their agreed billing terms until cancelled.
To limit repeated trials, we retain keyed hashes of previously used email addresses and verified mobile numbers. These are anti-abuse records, not marketing lists. A full refund of the current subscription period ends paid access for that period; partial refunds do not automatically end access.
